Diplomatic Immunity – Ireland arrests Ukrainian diplomat

November 16, 2010

Well dear readers, in a recent incident a Ukrainian diplomat was arrested in Ireland for drink driving.

Nobody reported injured, no reports of any damage, just a simple (as in straight forward) drink drive case…..other than the driver is a Ukrainian diplomat with immunity as per the Vienna Convention.

A serious enough incident to have the Irish send this diplomat home?  Unlikely.

A serious enough incident for Ukraine to waver his immunity for any case specific to this incident to go ahead?  Also unlikely……in fact many nations have an absolute rule never to waiver diplomatic immunity for its diplomats as it sets a precedent of waiver.

However, as most foreign diplomats are experienced civil service people and are well aware that within the Vienna  Converntion it states “without prejudice to their privileges and immunities, it is the duty of all persons enjoying such privileges and immunities to respect the laws and regulations of the receiving State.”…….except of course they all do whether it is espionage or ignoring parking tickets.

The question is ultimately what will Ukraine do with him me thinks.  Time for a move?
